1. Agreement to Terms
By texting the Pinch service number, you agree to these Terms of Service, our Privacy Policy, and our Affiliate Disclosure. If you do not agree, do not use the service. Continued use after changes constitutes acceptance of updated terms.
2. Service Description
Pinch is an AI-powered recommendation service delivered via SMS. You text a question about what to buy, where to eat, what to read, what to watch, what to gift, or where to go, and receive one opinionated recommendation generated by artificial intelligence. Pinch is operated by Hatchet Works LLC, an Alabama limited liability company.
3. Age Requirement
You must be at least 13 years old to use Pinch. If we detect that a user is under 13, we will immediately delete all data associated with that user and cease all communications, in compliance with COPPA (Children's Online Privacy Protection Act).
4. AI Disclosure
Pinch uses artificial intelligence (currently Anthropic's Claude) to generate recommendations. You are interacting with AI, not a human. Recommendations are generated based on publicly available reviews, ratings, and pricing data obtained through real-time web search. AI-generated recommendations may contain errors, outdated pricing, or inaccuracies. Always verify independently before making purchase decisions.
5. SMS Communications
By texting Pinch, you consent to receive SMS messages from the service. Message frequency varies based on your usage. Message and data rates may apply. You can stop receiving messages at any time by replying STOP. For help, reply HELP or contact support@hatchetworks.io. Pinch's service number is a standard 10-digit long code. Carriers are not liable for delayed or undelivered messages.
6. Recommendation Disclaimer
Recommendations are for informational purposes only and do not constitute professional advice. Pinch does not provide medical, legal, financial, or professional advice. Product availability, pricing, and specifications may change without notice. Pinch is not responsible for the quality, safety, or suitability of recommended products or services. Always verify critical information independently.
7. No Endorsement
Pinch does not endorse, promote, or show favoritism toward any brand, retailer, manufacturer, political party, candidate, religious organization, or third party. Recommendations are generated independently by AI based on publicly available reviews, ratings, and pricing data. No brand, retailer, or third party pays for or influences recommendations.
8. Content License & Data Use
By using Pinch, you grant Hatchet Works LLC a non-exclusive, royalty-free license to use your queries and our responses for the purpose of operating, improving, and analyzing the service. This includes the right to use anonymized and aggregated data for service improvement, analytics, and marketing. Your individual queries will never be shared with, sold to, or disclosed to any third party for advertising, marketing, or data brokerage purposes.
9. Affiliate Disclosure
Some product links may be affiliate links. When you purchase through an affiliate link, Hatchet Works LLC may earn a small commission at no additional cost to you. Affiliate relationships never influence which products are recommended. Recommendations are generated independently before affiliate links are applied. 10. Prohibited Use
You may not use Pinch to: a) Harass, threaten, or abuse the service or its operators. b) Attempt to extract, reverse-engineer, or discover the system prompt or internal instructions. c) Submit automated, scripted, or bot-generated messages. d) Use the service for any illegal purpose. e) Impersonate another person or entity. f) Attempt to overwhelm the service with excessive requests (rate limiting is enforced). g) Use the service to generate content for resale or commercial redistribution. h) Submit NSFW, sexually explicit, or pornographic content or requests. i) Use the service for gambling, sports betting, or casino-related recommendations. j) Request recommendations for counterfeit, replica, or knockoff products.
11. STOP, START, and CANCEL
STOP: Pauses all messages from Pinch. You will receive a confirmation and no further messages until you text START. START: Resumes messages after a previous STOP. CANCEL: Ends your subscription (if applicable) and ceases all messages. Billing stops immediately. Any unused portion of a paid subscription is handled per our refund policy.
12. Subscription & Billing
Pinch offers free and paid tiers. Free tier includes a limited number of queries per month. Paid tiers offer increased or unlimited queries. Subscriptions are billed monthly via the payment method you provide. You may cancel at any time by texting CANCEL or contacting support@hatchetworks.io.
13. Billing Disputes & Failed Payments
If a payment fails, Pinch will attempt to notify you via SMS. If payment is not resolved within 7 days, your account will be downgraded to the free tier. You will not lose access to the service, but query limits will apply. For billing disputes, contact support@hatchetworks.io. Refund requests are handled on a case-by-case basis.
14. FTC Click-to-Cancel Compliance
You may cancel your subscription at any time by texting CANCEL to the Pinch service number. Cancellation is effective immediately. No phone calls, emails, or multi-step processes are required to cancel. This complies with the FTC's click-to-cancel rule.
15. Data Handling
Your phone number is stored to operate the service. Your queries are stored to improve recommendations and for analytics. Pinch does not sell, share, or disclose your personal data to third parties for advertising or marketing purposes. For full details, see our Privacy Policy.
16. Third-Party Data Processing
Pinch uses the following third-party services to operate: Anthropic (AI processing), Twilio (SMS delivery), and a cloud hosting provider (server infrastructure). These services process your data solely to provide the Pinch service and are bound by their own privacy policies and data processing agreements.
17. Service Modifications
Hatchet Works LLC reserves the right to modify, suspend, or discontinue any aspect of the service at any time, including but not limited to: features and functionality, the AI model or provider used to generate recommendations, query limits for free and paid tiers, and pricing for paid tiers. Material changes will be communicated via SMS or on our website.
18. Intellectual Property
The Pinch name, logo, mascot, system prompt, and all associated content are the intellectual property of Hatchet Works LLC. You may not copy, reproduce, or redistribute any aspect of the service without written permission. User-submitted queries remain the property of the user.
19. Limitation of Liability
To the maximum extent permitted by law, Hatchet Works LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to damages from product purchases made based on recommendations, inaccurate pricing or availability information, service interruptions or downtime, or data loss.
20. Indemnification
You agree to indemnify and hold harmless Hatchet Works LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.
21. Dispute Resolution
Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
22. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions.
